Terms of Service for Software Development by TaTech
Let’s set expectations! This document covers what you can expect from TaTech and what we need from you to build a successful website and Mobile application.
Content and Backup:
- You are responsible for providing all content for your website.
- Back up your existing website data before TaTech starts working on it. TaTech is not responsible for any data loss.
Services Not Included:
- TaTech does not do data entry, web hosting, or custom artwork unless you specifically agree to pay extra for these services.
- They also don’t own any artwork, images, or text they create for you unless otherwise agreed.
Delivery Time:
- TaTech will try to meet deadlines, but there may be delays due to unforeseen circumstances.
Review and Approval Process:
- You will have a chance to review your website during design and after it is completed.
- If you don’t respond within 7 days, TaTech will consider the website approved.
Copyright:
- You are responsible for ensuring you have the right to use any content you provide to TaTech.
- You agree to indemnify TaTech for any copyright issues caused by your content.
Changes to Your Website:
- TaTech is not responsible for any changes you or a third party make to your website after it is launched.
- You may be charged a fee to fix any issues caused by these changes.
Cancellation Fee:
- If you cancel the project before it is completed, you may be charged a cancellation fee based on the amount of work already done.
Support:
- You get one month of free support after your website launches.
- After that, you will be charged according to TaTech ‘s pricing packages.
- Support only includes bug fixing and email support. It does not include fixing issues with the website’s architecture, rule changes, or add-ons.
Third-Party Products and Services:
- TaTech is not responsible for the accuracy or performance of any third-party products or services used in your website.
- Upgrades to third-party products or services may require additional charges.
Additional Work:
- Any new features or changes you request after the project scope is agreed upon will be considered additional work and may be billed extra.
Payment:
- You must pay TaTech ‘s fees in full by the due date.
Limitations of Liability:
- TaTech will use reasonable care while working on your website, but they do not guarantee its availability, quality, accuracy, or performance.
- TaTech is not liable for any loss or damage caused by your website, including damage to your own content.
- Their liability is limited, except in cases of death or personal injury caused by their negligence.
Approvals and Delivery:
- The project will proceed in stages. Work on the next stage will only start after you approve and pay for the previous stage.
- All code and materials will be transferred to you after the project is completed and you have signed off on everything.
- TaTech can use your completed website for marketing purposes unless you tell them otherwise in advance.
Severability:
- If any part of this agreement is found to be invalid, the rest of the agreement will still be enforceable.
